Errors And Omissions
Errors And Omissions
Under Kentucky law, insurance agents and brokers are not considered “professionals” and thus, do not owe the same duties as found in most professional liability claims. The legal duties imposed upon insurance agents and brokers are unique to this profession, as are the types of claims filed. The agency issues and law can be complex. Led by attorney and member Susan L. Maines, our attorneys have significant experience in and knowledge of these unique claims. Claims against insurance agents and brokers are often multifaceted and may well involve underlying liability claims, coverage issues, declaratory actions, “bad faith” and Consumer Protection Act claims in addition to alleged negligence or misrepresentation by the insurance agent or broker. The claims can involve any type of insurance policy as well as almost any type of underlying claim.
We can offer our clients not only specific expertise and knowledge of their profession, but also a history of successful summary motions and defense verdicts.
Susan Maines has been a frequent presenter and participant in conferences discussing the issues unique to insurance agents and brokers.
